| 内容記述 | 本稿では、主に憲法学の観点から、筆者が勤務する名桜大学を素材にはするが、大学の建学の精神及び教育の理念として“自由”を掲げることの意味について検討している。まず始めに、正当な理由もなく、“自由”を損なう差別や偏見、理不尽な扱いを現に受けているマイノリティ(社会的にその保護や理解が求められる者)たちの声を報告する。その声を通じ、社会の至る所に個人の“自由”をめぐる深刻な問題がまだ依然として多く存在することを私たちは認識しなければならない。次に、“自由”をめぐる先人たちの闘争やその歴史を紐解いてみる。そこから、“自由”がその価値に対する個々人の強靭な信念に支えられた理知的営みを基盤として初めて築かれてきたものであることが確認される。“自由”とは、誰かから難なく与えられるものではない。私たちはそもそも何故に“自由”でなければならないのであろうか。個人は、地球上の一生物ヒトとして生存するだけに止まらず、一人一人の存在がそのアイデンティティの多様さ故にかけがえのない価値のある存在だからこそ、“自由”が保障されなければならない。“自由”とは何か。憲法学の観点からは、“自由”とは、個人が人間らしくその尊厳を確保するために、人間としてその存在を根幹から支えている基本的人権である。“自由”を建学の精神あるいは教育の理念として標榜する大学にあっては、あらゆる研究や教育の領域において、“自由”の価値を尊重し、自由を侵す差別や偏見等の要因となる様々な壁と向き合い、打破できるような真摯な理知的営為が求められ続ける。 | |||||

| 内容記述 | In this article, we examine the meaning of "Liberty" as a Founding Spirit and one of the central educational philosophies at university level from the viewpoint of constitutional law. Firstly we report various minority voices crying out against discrimination and prejudice in Japanese society. These make us aware of the many problems concerning freedom and liberty. We then confirm that liberty is the fruit of relentless intellectual efforts to establish and maintain it in the age-old struggle for human freedom. Liberty is fundamental for us to live human lives. Liberty must be guaranteed in the constitutional law in order for people to secure their human dignity. Accordingly, at a university upholding liberty as a founding spirit. liberty must be not just honored to the maximum, but positively striven for on behalf of all people, not only in the academic and educational arenas, but also in the civil community and wider national and international society. | |||||
