| 内容記述 | 本稿では，2009年４月に沖縄県立美術館で行われたある企画展において，昭和天皇をモチーフにした作品を県美術館が非展示措置とした問題を素材として，憲法が基本的人権として保障する「芸術の自由」の意義と，地方自治法にその関連規定がある「公の施設」としての公立美術館のあり方が検討される。結論として，美術館のとった措置は，作品に反映された芸術家の人格や芸術の自由への適切な配慮を欠いた不当な措置であり，そして，行政当局により恣意的に選別されることのない多様な芸術作品を自由に鑑賞する一般公衆の知る権利や思想良心の自由を害するおそれがある。県美術館は本来その多様な利用形態にこそ特色のある，専門性ある公の施設である以上，住民にとって恣意的（と疑われるよう）な展示作品の選別は許容されない。今回の問題は，専門的かつ合理的な展示作品の選別の方法も含む，県美術館運営のあり方に大きな課題を残したと評価せざるを得ない。 | |||||

| 内容記述 | This article considers the recent case of the Okinawa Prefectural Art Museum's refusal to exhibit artwork involving the Emperor Showa. It focuses mainly on Government Speech in relation to several constitutional rights, including freedoms of thought and conscience and the freedom of artistic expression. It also examines the roles which public facilities such as art museums should fulfill. Although it is increasingly important that the modern state continues to encourage the cultural and artistic expression of individuals or organizations through substantial subsidies, public museums should not be permitted to censor exhibited works of art arbitrarily. | |||||
