| 内容記述 | 「子ども理解のための『指導・支援カルテ』」は，子どもの理解に資するためと称して，子ども本人や親権者には秘密にして，沖縄県内の全公立学校において2004年からすべての子どもを対象として教師によって作成されてきた，子どもの性格や家庭環境，問題行動等について詳細に記した文書である。カルテは，その作成手続上，県や市町村の個人情報保護条例に抵触し，そもそも子どものプライバシーの権利や教育を受ける権利等憲法上の基本的人権を著しく侵害するおそれのあるものである。本稿では，主として子どもの基本的人権保障の観点から，カルテと子どもの人権との関係を明らかにしつつ，このような学校教育の現場におけるカルテの問題性を詳細に検討する。また，カルテの問題の検討を通して明らかとなった，子どもの人権保障と個人情報保護制度との関係についても言及している。 | |||||

| 内容記述 | This article considers the privacy issues related to child education records, which contain details concerning children's character, domestic environment, misconduct and such, in terms of the fundamental human rights of children. The records which teachers make against all children in public schools in Okinawa infringe on the right to privacy, the right to control of personal information, the right to education, and others. We examine the relations between the records and the rights of children, between the systems protecting personal information and those securing the rights of children. | |||||
